Statement of National Immigrant Justice Center Executive Director Mary Meg McCarthy

CHICAGO (January 20, 2021) — President Joe Biden’s inauguration is an opportunity to re-imagine an  immigration system that is just and humane, supports family unity and strong communities, and confronts the legacy of racism and xenophobia that have put Black and Brown immigrants at risk for too long.

The National Immigrant Justice Center (NIJC) welcomes President Biden’s expected announcements to halt deportations, end the Muslim ban, fully restore the Deferred Action for Childhood Arrivals (DACA) program and Temporary Protected Status, and introduce legislation to provide a path to citizenship for 11 million people in our communities. These actions will help keep families together and make communities stronger, and will bring tremendous relief to thousands of people who have lived at the edge of disaster for the past four years, including hundreds of NIJC clients. These opportunities are possible thanks to the work of immigrants and advocates who have organized, advocated, and sometimes gone to court to demand a more just immigration system.

But these announcements will only be the beginning of repairing the damage of decades of immigration policymaking that has been founded in white supremacy. The Trump administration showed us the dangers of continuing our government’s reliance on detention and deportation to manage our immigration system. As Biden takes office, 15,415 people are in immigration detention at risk of contracting COVID-19 and thousands of asylum seekers are trapped in Central America and Mexico, barred from seeking protection. Our nation can and must do better.

In its first 100 days, we call on the new administration to repair and redress harms and embrace transformative change:

  1. Champion passage of a legalization bill that provides an opportunity for citizenship for everyone living in the United States without lawful status, including those who have faced arrest or conviction in the racially discriminatory criminal legal system.
  2. Defund the immigration detention system and halt the militarization of the southern border, and embrace community-based case management programs for individuals who need support while pursuing their immigration cases.
  3. Ensure meaningful protection for people who come to the United States seeking asylum from persecution, and other violence by ending Title 42 expulsions and the harmful Migration Protection Protocols.
  4. Stop the police-to-deportation pipeline by ending cooperation and information sharing between local law enforcement agencies and federal immigration enforcement.
  5. Suspend all prosecutions for unauthorized entry and reentry, which are rooted in a history of racism and violate the U.S. government’s obligations under the International Refugee Convention.
  6. Move quickly to develop an appointed counsel program for all immigrants facing deportation who cannot afford an attorney, and secure funding in the next federal budget to support a holistic program.

NIJC Llama a la Administración de Biden Para Reimaginar Un Sistema Migratorio Basado en Igualdad Racial y Compasión

La inauguracion de Joe Biden es una oportunidad para reimaginar un sistema migratorioque es justo y humano, apoya a la unidad familiar y comunidades fuertes, y se enfrenta al legado de racismo y xenofobia que han puesto a inmigrantes Negros y otras personas de color en riezgo por demasiado tiempo.

El Centro Nacional de justicia para Inmigrantes (NIJC) da la bienvenida a los anuncios anticipados del Presidente Biden que pararan las deportaciones, acabarán con la Prohibición de Musulmanes, restaurarán completamente los programas de Acción Diferida para los Llegados en Infancia (DACA) y Estatus de Protección Temporal (TPS), e introducirán legislación para proveer un camino a la ciudadanía para 11 millones de personas en nuestras comunidades. Estas acciones ayudarán a mantener a familias juntas y harán comunidades más fuertes, y traerán alivio enorme a miles de personas que han vivido a la orilla del desastre por los últimos cuatro años, incluyendo cientos de clientes de NIJC. Estas oportunidades son posibles gracias al trabajo de inmigrantes y defensores que han organizado, apoyado, y hasta ido a corte para exigir un sistema migratorio más justo.

Pero estos anuncios serán solo el principio de reparar el daño después de décadas de políticas migratorias basadas en la supremacía blanca. La administración de Trump nos enseñó los daños cuando nuestro gobierno continúa la dependencia en la detención y deportación de los inmigrantes para manejar nuestro sistema migratorio. Mientras Biden asume su cargo, 15,415 personas están en detención de inmigración con riesgo de contraer COVID-19 y miles de solicitantes de asilo están atrapados en Centroamérica y México, prohibidos de buscar protección. Nuestra nación puede, y debe de aspirar a algo mejor.

En sus primeros 100 días, llamamos a la nueva administración que repare y rectifique daños y adopte cambio transformativo:

  1. Luchar por una propuesta de ley que dé la oportunidad de obtener ciudadanía a todos viviendo sin estatus legal en los Estados Unidos, incluyendo aquellos que han enfrentado arresto o convicción en el sistema criminal legal el cual es racialmente discriminatorio.
  2. De-financiar el sistema de detención de inmigración y parar la militarización de la frontera sureña, y adoptar programas de manejo de caso basados en la comunidad para individuos que necesitan apoyo mientras presentan sus casos de inmigración.
  3. Parar el canal de policía-a-deportación al eliminar la cooperación y el comparto de información entre agencias policiales locales y oficiales de inmigración federales.
  4. Suspender todas las prosecuciones de entrada y re-entrada sin autorización, que tienen sus raíces en una historia de racismo y violan las obligaciones del gobierno de E.E.U.U. bajo la Convención Internacional de Refugiados.
  5. Moverse rápidamente para desarrollar un programa de representación legal designada para todos los inmigrantes enfrentando deportación que no pueden pagar por un abogado por su propia cuenta, y asegurar fondos en el siguiente presupuesto federal para apoyar un programa holístico.
