Yesterday a federal court judge in Washington, D.C., ruled that the Title 42 mass expulsions policy, originally designed and implemented by the Trump administration and recently expanded by the Biden administration, is unlawful under the Administrative Procedures Act. The judge therefore vacated the policy, with nationwide application.

National Immigrant Justice Center Executive Director Mary Meg McCarthy responded to the ruling:

"A federal judge has found that people seeking asylum at the U.S. border 'face irreparable harm that is beyond remediation’ in the form of the Title 42 mass expulsions policy. We are overjoyed at this long overdue affirmation of the blatant illegality of the use of Title 42 as a de facto asylum ban at the southern border. We also keep in our hearts the thousands of people who have endured assaults, kidnappings, and other harms because they were returned to dangerous conditions by Title 42 expulsions. And we grieve those whose lives have been lost. We call on the administration to heed the court order with urgency and end the suffering Title 42 has unleashed by immediately restoring access to asylum at the southern border.”
