The Supreme Court agreed to hear the appeal of Roselva Chaidez, a lawfully present non-citizen who argues that her criminal lawyer failed to properly represent her when he advised her to plead guilty to a crime in 2003 without telling her that her plea would result in her deportation. There is now a formal rule that attorneys much notify their clients of the immigration consequences of a guilty plea, but the rule does not apply retroactively. However, the Supreme Court could set a new precedent if it rules in Ms. Chaidez's favor. NIJC is one of the groups representing Ms. Chaidez.
