Terms of Use

1. Welcome to the National Immigrant Justice Center.  By using any part or all of the NIJC website, NIJC assistant chatbot (the “Chatbot”), and the NIJC appointment scheduling portal (the “Portal”) (collectively, the “Site”), you agree to these terms of service (“Terms”). If you do not agree, please do not use the Site.

2. Information Not Legal Advice. Legal information is not the same as legal advice, which is the application of law to an individual’s specific circumstances in the course of an attorney-client relationship. The information on and provided through the Site, including, without limitation, information, material, and referrals provided through the Site, is not legal advice. Your use of the Site does not create an attorney-client relationship between you and NIJC. The information you provide to the Site is not protected by attorney-client privilege, but we do make reasonable efforts to maintain the information you provide in accordance with our Privacy Policy. You should not and are not authorized to rely on the Site as a source of legal advice. Always seek advice from a licensed attorney before making any decisions. The Site should never be used as a substitute for a consultation with a licensed attorney.

3. User Responsibilities. The following requirements apply to your use of the Site:

  1. You will not use any feature of the Site for any purpose that is unlawful, tortious, abusive, invasive of privacy or publicity rights, harassing, libelous, defamatory, embarrassing, obscene, indecent, lewd, suggestive, threatening, fraudulent, inflammatory, or hateful;
  2. You will not upload, post, reproduce, or distribute any information, software, or other material protected by copyright or any other intellectual property right (as well as rights of publicity and privacy) without first obtaining the permission of the owner of such rights;
  3. You will not collect or store personal data about other users without their consent;
  4. You will not impersonate another user or misrepresent your affiliation with another user;
  5. You will not use or attempt to use another user’s account without authorization from that user and NIJC;
  6. You will not use the Site for any commercial purpose not expressly approved by NIJC in writing;
  7. You will not upload, post, email, or otherwise transmit any advertising or promotional materials or any other form of solicitation or unauthorized communication;
  8. You will not submit or otherwise transmit any material or information that contains viruses or any other computer code, files, or programs which might interrupt, limit, or interfere with the functionality of any computer software or hardware or telecommunications equipment or network, or that may otherwise adversely affect the operation of the Site, any feature of the Site, or other users’ ability to access and enjoy their use of the Site;
  9. You will not develop or use any third-party application to engage in reverse engineering, data mining, scraping, crawling, or use any robot or other similar method or tool to harvest, gather, or extract data, content, or other information from the Site for any purpose, including but not limited to training any artificial intelligence models; and
  10. You will not engage in, encourage, or promote any activity that violates these terms.

You further understand and agree that you have no ownership rights in any account you may have with us or other access to the Site or features therein.  NIJC may cancel your account and delete all content associated with your account at any time, and without notice, if in its sole discretion for any reason, including but not limited to NIJC’s belief that you have violated these Terms or the law.  NIJC assumes no liability for any information removed from the Site and reserves the right to permanently restrict access to the Site or a user account.

4. Data Collection and Privacy. The Site may collect and store data such as conversation logs, user preferences, and interaction details to improve user experience and functionality.  If you create an account in the Site, the Chatbot will collect your email address or phone number, and the Portal will collect personally identifiable information about you, including your name, date of birth, email address, phone number, address, and personally identifiable information about members of your household. By using the Site, you consent to the collection, use, and storage of your data in accordance with our Privacy Policy. We do not sell, rent, or distribute your personal information to third parties without your explicit consent, except as required by law.

5. Intellectual Property. The Site and the legal information, text, graphics, images, photographs, videos, illustrations, trademarks, trade names, service marks, logos, slogans and other content contained therein (collectively, the “Content”) are owned by or licensed to NIJC and are protected under both United States and foreign laws. Except as explicitly stated in these Terms, NIJC and our licensors reserve all rights in and to the Site and the Content. You are hereby granted a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use our Site and Content for your own personal use; however, such license is subject to these Terms and does not include any right to (a) sell, resell or commercially use our Site or Content; (b) copy, reproduce, distribute, publicly perform or publicly display Content, except as expressly permitted by us or our licensors (which includes using the legal information provided through the Site for the purpose of informing your approach to your legal case); (c) modify the Content or remove any proprietary rights notices or markings from Content; (c) use any data mining, robots or similar data gathering or extraction methods; or (d) use our Services or Content other than for their intended purposes. Any use of our Site or Content other than as specifically authorized herein, without our prior written permission, is strictly prohibited and will terminate the license granted herein.

6. Limitation of Liability; Disclaimer of Warranties. The Chatbot is powered by artificial intelligence (AI) and is provided for informational and general assistance purposes only. While we strive to ensure accuracy, the Chatbot may produce incorrect, outdated, or misleading information. NIJC does not guarantee the accuracy, reliability, or completeness of any Chatbot responses. You acknowledge that AI technology is continually evolving, and as such, errors and misinterpretations may occur.

NIJC makes no representations about the accuracy of the information on the Site or the reliability of the features of the Site, and disclaims all liability in the event of any service failure. You acknowledge that any reliance on such material or Sites will be at your own risk. NIJC makes no representations regarding the amount of time that any information you provide to the Site will be preserved.

We also use information about your use of the Site to improve the content of the Site, to improve NIJC’s marketing and promotional efforts and to statistically analyze Site usage patterns on an aggregate basis.

THE SITE (INCLUDING, WITHOUT LIMITATION, ALL INFORMATION AND CONTENT CONTAINED HEREON) IS PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS. NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO THE SITE OR ANY INFORMATION, SERVICE OR SOFTWARE THEREIN. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL NIJC OR ANY NIJC EMPLOYEES, BOARD MEMBERS, DONORS, PARTNERS, AGENTS, OR ANY OTHER NIJC-AFFILIATED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (COLLECTIVELY, “DAMAGES”) RESULTING FROM USE OF THE SITE, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES, MISSED OPPORTUNITIES, OR RELIANCE ON INCORRECT INFORMATION. UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO A NEGLIGENT ACT, WILL NIJC OR ANY NIJC EMPLOYEES, BOARD MEMBERS, DONORS, PARTNERS, AGENTS, ATTORNEYS, OR ANY OTHER NIJC-AFFILIATED PARTIES BE LIABLE FOR ANY DAMAGE OF ANY KIND THAT RESULTS FROM THE USE OF, OR THE INABILITY TO USE, THE SITE, EVEN IF NIJC OR ANY NIJC EMPLOYEES, BOARD MEMBERS, DONORS, PARTNERS, AGENTS, ATTORNEYS, OR ANY OTHER NIJC-AFFILIATED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

7. Changes to These Terms. We reserve the right to update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms. We recommend checking this page periodically for any updates.

8. Governing Law. These Terms will be governed by and construed in accordance with the laws of the state of Illinois in the United States of America without regard to conflicts of laws principles. By using the Site, you hereby agree that any and all disputes regarding these Terms will be subject to the federal and state courts located in Cook County, Illinois. YOU AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SITE AND/OR THESE TERMS, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. These Terms operate to the fullest extent permissible by law.

9. Termination of Use. We reserve the right to terminate or suspend your access to the Site at our discretion, without prior notice, if we determine that you have violated these Terms or engaged in any misuse of the Site.

10. Indemnity.  You agree to indemnify, defend and hold NIJC, its employees, board members, donors, partners, agents, attorneys, and any other NIJC-affiliates parties, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, due to or arising out of your use of the Site and/or breach of these Terms.

11.  Notice and Procedures for Claims of Infringement.  If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide the following information to the Site’s Copyright Agent:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
  2. A description of the copyrighted work or other intellectual property that you claim has been infringed;
  3. A description of where the material that you claim is infringing is located on the Site (providing URL(s) in the body of the communication is the best way to help NIJC locate content quickly);
  4. Your name, address, telephone number and e-mail address;
  5. A signed statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement by you, made under penalty of perjury, that the information provided in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

13. Miscellaneous Provisions.

  1. No Partnership.  Both you and NIJC acknowledge and agree that no partnership is formed and neither you nor NIJC has the power or the authority to obligate or bind the other.
  2. Force Majeure.  The failure of NIJC to comply with these Terms because of an act of God, war, fire, riot, terrorism, earthquake, actions of federal, state or local governmental authorities or for any other reason beyond the reasonable control of NIJC, shall not be deemed a breach of these Terms.
  3. No Waiver.  If NIJC fails to act with respect to your breach or anyone else’s breach of these Terms on any occasion, NIJC is not waiving its right to act with respect to future or similar breaches.
  4. Severability.  If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
  5. Binding Agreement.  These Terms constitute a binding agreement between you and NIJC and is accepted by you upon your use of the Site.  By using the Site, you represent that you are capable of entering into a binding agreement and that you agree to be bound by these Terms.
  6. Time Limitation.  Any cause of action or claim you may have with respect to these Terms or the Site must be commenced within six (6) months after the claim or cause of action arises or such claim or cause of action shall be barred.
  7. Entire Agreement.  These Terms constitute the entire agreement between you and NIJC regarding the use of the Site.
  8. Acceptance of Terms.  You acknowledge and agree that your acceptance of these Terms and your use of the Site constitutes your “electronic signature” indicating your desire to use the Site.  Your “electronic signature” indicates your acceptance of these Terms.
