Increasingly, the Department of Homeland Security (DHS) is filing motions to pretermit asylum applications, sometimes on the eve on an individual hearing and sometimes at the prompting of the immigration judge. These motions may be based on allegations the Form I-589 is incomplete or fails to state a claim or based on an Asylum Cooperative Agreement and the safe third country principle.
