Sample Comment: Oppose the BIA Rule Eliminating Judicial Review

The Department of Justice published an interim final rule on Appellate Procedures for the Board of Immigration Appeals (BIA) dramatically changing how the BIA operates and eliminating meaningful judicial review. As an attorney who has defended people in the immigration or legal system, you have valuable insight and your voice is incredibly important. If your firm isn’t comfortable with you commenting on behalf of your firm, please still consider submitting a comment in your capacity as an individual pro bono attorney. Submit your comment before the public comment period ends on April 8, 2026.

Visit the page on Regulations.gov where the “Appellate Procedures for the Board of Immigration Appeals” rule is posted. Click on the green button at the top of the page that says, “Submit a Public Comment.” Complete the form and click on the green “Add a File” button to upload your comment. Click the “Submit Comment” button at the bottom to submit your comment to the Federal Register.
