Local Immigration Advocates Condemn Trump Administration’s Threats and Remind Communities of Steps to Take to Defend their Rights

Chicago immigrant rights advocates and attorneys condemn potential Immigration and Customs Enforcement (ICE) plans to conduct a nationwide immigration enforcement operation starting Sunday. Credible sources have indicated that Chicago is a target for the operation, which is expected to target families and young adults who entered the United States as unaccompanied children.

Advocates from the National Immigrant Justice Center (NIJC), Illinois Coalition for Immigrant and Refugee Rights (ICIRR), and PASO-West Suburban Action Project are sharing the following critical information for families and communities preparing to defend their rights during these actions:
 

Know Your Rights:

1. Create a safety plan in advance:

  • Identify your emergency contact and memorize their phone number
  • Provide your child’s school or day care with the emergency contact name and phone number and provide authorization for the emergency contact to pick up your child
  • Provide authorization for your emergency contact to make medical and legal decisions for your child
  • Keep your passport, identity information, proof of physical presence in the U.S. and financial information in a safe location. Make sure your emergency contact can access them

2. Obey traffic and criminal laws and carry a valid state ID and/or work permit. Do not carry any false/fraudulent documents that do not correspond to your identity.
 
3. Exercise your rights during an enforcement action:

  • If you are pulled over in a traffic stop: Ask if the officer is from the local police department or ICE. Immigration officers often identify themselves as “police,” but it is important to know what agency they represent. If they are ICE officers, you do not need to answer any questions or provide any documentation before you speak with a lawyer.
  • If an officer knocks on your door: Do not open the door. Officers must have a warrant signed by a judge to enter your home. ICE warrants are not signed by judges.
  • All people have the right to remain silent. You do not have to answer any questions or show any documents to an immigration officer. Ask to speak with a lawyer.

  • Immigration legal representation:
    • NIJC and the City of Chicago Legal Protection Fund: Chicago residents are eligible for free legal services from NIJC through the City of Chicago Legal Protection Fund. Immigrants outside Chicago also can obtain low-cost legal consultations and representation from NIJC. Call (312) 660-1370 or email nijcild@heartlandalliance.org to make an appointment.
    • Community-Based Legal Clinics: See ICIRR’s list of community-based organizations providing immigration legal assistance.

If you are a U.S. citizen and witness an ICE enforcement action:

  • Help document the action and hold ICE accountable. If it is safe to do so, record the action with your phone and contact the Family Support Hotline or local community advocates to let them know what happened.
  • Inquire with your local police department about their role in ICE enforcement operations.

Defensores locales de la inmigración condenan las amenazas de la Administración de Trump y les recuerdan a las comunidades de los pasos a seguir para defender sus derechos

Defensores de los derechos de los inmigrantes y abogados de Chicago condenan los planes de la Agencia de Inmigración y Control de Aduanas (ICE) de llevar a cabo una operación de control de inmigración a nivel nacional a partir del domingo. Fuentes confiables han indicado que la ciudad de Chicago es un objetivo para la operación, también han indicado que las redadas enfocarían en las familias y adultos jóvenes que ingresaron a los Estados Unidos como menores no acompañados.
 
Representantes del Centro Nacional de Justicia para Inmigrantes (NIJC), la Coalición de Illinois por los Derechos de los Inmigrantes y Refugiados (ICIRR), y el Proyecto de Acción de los Suburbios del Oeste comparten la siguiente información crítica para las familias y comunidades que se preparan para defender sus derechos durante estas redadas:


Conozca Sus Derechos:

1. Prepare un plan de acción:

  • Identifique su contacto de emergencia y memorice su número de teléfono
  • Proporcione el nombre y número de teléfono de su contacto de emergencia  a la escuela o guardería de su hijo y autorice al contacto de emergencia para que pueda recoger a su hijo
  • Proporcione autorización para que contacto de emergencia pueda hacer decisiones médicas y legales para su hijo
  • Reúna su pasaporte, documentación de identidad, pruebas de presencia física en los EE.UU., e información financiera en un lugar seguro. Asegúrese que su contacto de emergencia tenga acceso a éstos.

2. Obedezca las leyes criminales y de tráfico y lleve una identificación estatal y/o un permiso de trabajo válido. No cargue ningún documento falso con usted que no corresponda a su identidad.

3. Ejercite sus derechos durante una parada:  

  • Si es detenido en una parada de tránsito: Pregunte si el oficial es del departamento de policía local o ICE. Los oficiales de inmigración frecuentemente se identifican como "policías," pero es importante saber a qué agencia representan. Si son oficiales de ICE, no es necesario que responda ninguna pregunta ni proporcione ningún documento antes de hablar con un abogado.
  • Si un oficial toca a su puerta: No abra la puerta. Los oficiales deben tener una orden firmada por un juez para ingresar a su hogar. Las órdenes de ICE no están firmadas por los jueces.
  • Todas las personas tienen el derecho de permanecerse en silencio. No tiene que responder ninguna pregunta ni mostrar ningún documento a un oficial de inmigración. Pida hablar con un abogado.
