In this case, the Government argued that a finding by the Board of Immigration Appeals that Mr. Klementanovsky was an aggravated felon was not reviewable.  National Immigrant Justice Center pro bono attorney Morgan Hirst, of Jones Day, succeeded in persuading the Court to reject this argument and made it possible for his client to advance an equal protection claim relating to the granting of waivers of inadmissibility.
