On October 1, 2015, the Executive Office for Immigration Review (EOIR) published a Final Rule, Separate Representation for Custody and Bond Proceedings, effective December 7, 2015. Under this final rule, EOIR amended the Form EOIR-28 to require a representative to indicate if he or she is entering an appearance for custody and bond proceedings only, any other proceedings only, or for all proceedings.

As of Monday, December 7, 2015, attorneys must use the new form E-28. EOIR will honor the prior version of E-28 for cases received and dated prior to December 7, 2015. Please note that these cases will be treated as an appearance for all proceedings.

Please note that Form E-28 is only for attorneys representing clients before the immigration court.  Attorneys appearing or filing applications before the Department of Homeland Security (DHS)/U.S. Citizenship and Immigration Services (USCIS)/Immigration and Customs Enforcement (ICE) must file the G-28 appearance form.
