In the settlement for this Freedom of Information Act action, Muslim Civil Rights Center et. al. v. Department of Homeland Security, the government certified that it has never used the terrorist detention provisions of the USA PATRIOT Act.
This case also showed that the government's enforcement actions at locations such as O'Hare Airport, which are generally labeled as terrorism prosecutions, have only resulted in the arrest of undocumented workers on immigration violations. Such disclosure strengthens the ability of the National Immigrant Justice Center and others to conduct oversight of the government's use of anti- terrorism laws.
